What Is The Process For Bankruptcy?

First, make an appointment with us to go over your situation, so we can see if it is the best solution for you. Once that decision is made, then we will fill out all of the bankruptcy paperwork with your help. The bankruptcy petition would be filed in court after you have attended the first credit counseling class that is required in order to be able to file a bankruptcy. One more of those classes is necessary before you can have your debts discharged (wiped out). You will also need to attend one court hearing, which is often called a "341 meeting of creditors." We will be there with you. The process is routine and usually takes five to 15 minutes. We will be with you the entire time and help you if necessary. You will get notice of that hearing date several weeks in advance so you can make arrangements to get off work or childcare, etc. Usually, after the 341 meeting of creditors there is nothing more for you to do except wait for the bankruptcy discharge papers to arrive. The entire bankruptcy process can be started and concluded in as little as four to six months.
